PRIVATE VEHICLE STORAGE LICENSE AGREEMENT

1. Nature of Agreement – Storage License Only

This Agreement constitutes a revocable vehicle storage license only.

It does not create a lease, tenancy, possessory interest, or any real property rights.

The Owner retains exclusive possession and control of the property at all times.

2. Acceptance by Conduct

This Agreement becomes legally binding automatically when a vehicle is delivered,

parked, or left on the property located at 6249 W Gowan Rd.

No written signature is required. The person leaving the vehicle shall be deemed

the Responsible Party and contracting party under this Agreement.

3. Anti‑Tenant Clause (No Tenancy Created)

The parties expressly agree this Agreement does NOT create a landlord‑tenant relationship.

Nevada landlord‑tenant laws do not apply to this Agreement.

The Responsible Party does not acquire any right of occupancy, tenancy, leasehold,

or possession of the property.

Living, sleeping, or residing in any vehicle on the property is strictly prohibited.

4. Eviction Waiver

The Responsible Party expressly waives any claim that eviction proceedings are required

to remove the vehicle from the property.

The Owner may demand removal of the vehicle or tow the vehicle immediately if

this Agreement is violated.

5. Term of Storage

This Agreement operates on a month‑to‑month basis.

Billing period: the first day through the last day of each calendar month.

If a vehicle remains on the property after the start of a new month,

the next monthly storage fee automatically applies.

6. Payment Terms

Payments may be made via Zelle to 725‑212‑0627, cash, or other methods approved by Owner.

All fees must be paid before a vehicle may be removed from the property.

Failure to pay storage fees may result in towing or lien enforcement.

7. Access Hours

Access hours: 9:00 AM – 5:00 PM.

At least 24 hours advance notice is required to retrieve a vehicle.

Owner may require up to 3 days notice to coordinate access and verify ownership.

8. Permitted Vehicles

Allowed vehicles include cars, trucks, trailers, boats, RVs, and commercial vehicles.

Vehicles must be operational and legally registered.

Owner reserves the right to refuse any vehicle deemed unsafe or hazardous.

9. Prohibited Uses

The following activities are prohibited:

  • living or sleeping in vehicles
  • mechanical repairs
  • commercial operations without permission
  • storage of materials or goods
  • dumping waste or hazardous substances

If a vehicle is repeatedly removed and returned multiple times per week,

the storage space may be reclassified as contractor workspace and rent may increase by 30%.

10. Insurance Requirement

Responsible Party must maintain valid insurance coverage for the vehicle.

Owner does not provide insurance coverage.

Owner is not responsible for damage, theft, vandalism, weather, or third‑party acts.

11. Limitation of Liability

Vehicles are stored entirely at the Responsible Party’s own risk.

Owner assumes no liability for loss, damage, theft, vandalism, fire,

weather damage, or acts of third parties.

12. Vehicle Retention Lien

Owner shall have a contractual lien against any stored vehicle for unpaid rent,

damages, towing costs, storage fees, and administrative expenses.

Owner may retain possession of the vehicle until all outstanding amounts are paid.

13. Tow Authorization

Responsible Party authorizes Owner to tow or remove the vehicle at the Responsible Party’s expense if:

  • rent is unpaid
  • the Agreement is violated
  • the vehicle is abandoned
  • the vehicle creates safety concerns

14. Abandoned Vehicles

A vehicle may be considered abandoned if rent remains unpaid for more than 30 days,

the Responsible Party cannot be contacted, or the vehicle remains after termination.

Owner may tow, store, or dispose of the vehicle as permitted under Nevada law.

15. Indemnification

Responsible Party agrees to indemnify and hold harmless Anthony Torres from any claims,

damages, injuries, lawsuits, or liabilities arising from the vehicle or its presence

on the property.

16. Property Damage

Responsible Party is responsible for any damage caused to the property including

oil spills, fuel leaks, structural damage, fence damage, or contamination.

17. Small Claims Jurisdiction

Any disputes arising from this Agreement shall be resolved in Small Claims Court

located in Clark County, Nevada unless otherwise required by law.
